Ship Bottom, NJ HOA

I belong to an HOA in Ship Bottom, NJ. The previous Board and New Board have violated a number of laws and disregarded the Master Deed.

They were caught not paying their assessments and have told me they will not pay back money. This is theft and they should be removed from the Board as per the Radburn Act. This is also a violation of their fiduciary duties.

They refuse to pay for common expenses of my Unit, but they make sure to pay others. This has cost me thousands of dollars and they now introduced back dating the Master Deed to reflect their new agenda all without a vote.

I've asked for an ADR meeting back in August of 2023 and they have since ghosted me without any response.

I have retained a lawyer but are there any other avenues to pursue their illegal activity.

Welcome tferris from NJ Help member, Margie Tenerovich from Cherry Hill, NJ. I also looking for ENFORCEMENT of the Radburn Act as are you. Have not found a lawyer yet that is without bias and joined at the hip with CAI. Hope we can be of help on this forum.

Unfortunately, not complying with Governing Docs and State Regulations is the number 1 complaint that we hear. There is really no way to enforce such things unless you pay out of pocket for your own attorney. But, many of us have spent money for legal representation without much success. That's why we are aggressively fighting to enact more laws that give Homeowners more rights in their communities because the scales are HEAVILY tipped in favor of the Board.
